RESOLUTION

of the NORTH CAROLINA CONFEDERATION OF MOTORCYCLE CLUBS

 

WHEREAS, Discrimination in any form and against any citizen or group of citizens is contrary to the spirit and intent of the Constitution and the principles upon which the United States was formed; and

WHEREAS, Federal and State law prohibit discrimination on the basis of race, color, religion, or national origin in hotels, motels, restaurants, theaters, and all other public accommodations engaged in interstate commerce as well as by government agencies; and

WHEREAS, There have been instances of commercial establishments in North Carolina and in other states denying access to motorcyclists solely on the basis of their attire; and

WHEREAS, Some law enforcement entities in North Carolina and in other states have conducted “motorcycle-only” traffic stops solely on the basis of motorcyclists’ mode of travel; and

WHEREAS, The North Carolina General Assembly recognized the problem of discrimination against motorcyclists on the basis of mode of travel and enacted S 381 (Checking Station Pattern Selection) as SL2011-216 preventing law enforcement agencies from establishing patterns for vehicle stops at checking stations based on a particular type of vehicle; and

 

WHEREAS, Instances of motorcyclist profiling and discrimination against motorcyclists on the basis of attire continue to this day.


NOW THEREFORE BE IT RESOLVED THAT, The North Carolina Confederation of Motorcycle Clubs (hereinafter, the “Confederation”) respectfully requests that the CBA/ABATE of NC at the earliest opportunity seek introduction of and actively support legislation in the North Carolina General Assembly prohibiting discrimination against motorcyclists on the basis of attire and mode of transportation; and

BE IT FURTHER RESOLVED THAT, The Confederation pledges to actively support the efforts of the CBA/ABATE of NC in seeking enactment of such legislation; and

BE IT FURTHER RESOLVED THAT, A copy of this resolution be transmitted to the CBA/ABATE of NC and be included in the Minutes of the meeting of the Confederation of 14 April 2013.
